Welcome toTalivio Technology OÜ("Company", "we", "our", "us"). By registering for an account, accessing, or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms shall be governed by and defined following the laws of theRepublic of Estonia. Talivio Technology OÜ and yourself irrevocably consent that the courts of Estonia shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

As a consumer based in the European Union, you may benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms, including the paragraph above, affects your rights as a consumer to rely on such mandatory provisions of local law.

3. Data Protection and Privacy

We are committed to protecting your personal data in accordance with theGeneral Data Protection Regulation (GDPR) (EU) 2016/679. Our collection/use of personal data is described in ourPrivacy Policy.

By using our Service, you acknowledge that your data may be processed in secure data centers located within theEuropean Union, under strict security protocols compliant with ISO/IEC 27001 standards.

4. User Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify us of any unauthorized use of your account. We implement industry-standard encryption (SSL/TLS) for data transmission and storage, but you acknowledge that no method of transmission over the Internet is 100% secure.

5. Service Availability and SLA

We strive to provide 99.9% service uptime. However, we do not guarantee that the Service will be uninterrupted or error-free. We reserve the right to modify, suspend, or discontinue the Service (in whole or in part) with or without notice for maintenance or updates.

6. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Talivio Technology OÜ, its affiliates, officers, directors, employees, agents, suppliers or licensors be liable for any indirect, special, incidental, punitive, exemplary or consequential damages, regardless of legal theory, whether or not we have been warned of the possibility of such damages.

7. Refund Policy

Our refund policy is governed by EU Consumer Rights Directive. You have the right to withdraw from a customized enterprise contract only as stipulated in the specific service agreement. For standard plans, specific refund terms apply as detailed in your subscription agreement.
